The American judicial system is HIGHLY ROTTEN. Even those cases that went to trial can be totally wrongly decided. Those cases that never went to trial yet, but were merely based on the words of the Prosecutor may very well be the EXACT OPPOSITE of the truth. Look at Wen Ho Lee, in which case Pres. Clinton and the presiding Judge both apologized. So I would not put much credence in what the Prosecutor says about Prof. Cheung.
Horai's comments are reasonable in OTHER PLACES, but not in the U.S. because of its unique corrupt judicial system. All federal prosecutors, U.S. Attorneys (USA) or Assistant U.S. Attorneys (AUSA) are political appointees of the President, and so it's a matter of "who you know, not what you know". Since they are all appointed, the USAs have little control over the AUSAs, with a result that mostly prosecution is hell on earth, these USA/AUSA can prosecute anyone they feel like. After a few years they easily become judges, senators, congressmen. The federal statutes are also extremely broad and extremely harsh: e.g. wire fraud is saying a falsehood on phone, e-mail etc. for gain. So if you make 25 phone calls, 25 e-mails, that's 50 instances, that is 20 years for EACH INSTANCE. Also, these people have a 96% conviction success rate. I believe W.H. Lee actually qualified for the death penalty. After consulting with qualified attorneys, Prof Cheung probably came to the conclusion that he would go at least 3 years, possibly 100 years in prison, even after spending 10 million in attorney fees. The Wikipedia entry even says the prosecution had ulterior motives. In such circumstance the choice is simple for Mr. Cheung, he should never go back to U.S. like Snowden decided to do (although Snowden might well get a political settlement).

The law on abandoning citizenship changed: used to be, you can take out another passport (e.g. PRC) and you automatically lose U.S. citizenship. These days you need to be interviewed at the Consulate. They don't have power to arrest you (remember Sun Yat-sen at the Qing consulate in London). However, if you abandon citizenship in order to evade U.S. tax, they will REFUSE you.

刪除張五常人格有點大問題,被指控明目張膽處心積慮非常離譜的去避稅。。。他們絕不能回美,單單這存心策劃的逃稅,就不是罰巨額罰款可以解決。。。好奇他們有沒有透過律師正式放棄美藉(不會對避稅䅁有幫助,但起碼沒有在國外一直瞞稅的大患)。。。

此張五常人格有問題,建議佢快點回美認罪,繼而入獄做番份獄中經濟學研究,話唔定會獲獎。

刪除放棄美藉,可以到外國的美國領事館辦。但張先生一踏入中國的美領事館就會被捕,所以要透過律師,但我不知可否透過律師放棄美藉。張先生一日是美藉,他著草其間一樣要每年誠實報稅,包括他在國外所有資產入息,否則有一日落在美國手裡,這瞞稅案是逐年積纍,張先生極可能罪成坐一世監。。。

刪除李文和䅁李先生有不當下載不少「機密」檔案,此點沒有疑問,疑問只是動機,美政府說是間諜,李先生說是帶工作回家硏究。美政府錯在以不良手法企圖廹供(長期單獨囚禁,出外任何活動鎖鍵上身),李先生在獄受委屈沒有置疑,而政府也為此賠償了九十萬美元,加上媒體的賠償,總賠償額是一百六十萬美元。。。政府最終只留一控罪,而李文和亦承認控罪。司法有不公,但最終政府是錯認打企定。
以李文和案來做例子,這「免罪金牌」的藉口,還真能瞞人?未免太侮辱人的智慧。
美國當然有寃案,但所有真正寃䅁受害人(被錯誤定罪)絕大部分是窮人,沒錢請最好律師。張五常據聞有近一千萬美元資產被凍結在美國,假如他們是清白,會不回美請最好律師同政府死過。。。逃稅案絕少不准保釋(但會不准離境),張先生寧放棄在美國所有資產。。。嘿嘿嘿嘿
回覆刪除美國瞞稅案,很多時稅局明知「漏報稅」是成機搏懞,但通常都是罰重款(可以多過你漏報稅之總款額)算數(不起訴),真正起訴要你坐監個䅁,是渉金額大而又非常離譜存心策劃之避稅(例如做假商業文件)。。。稅局胸有成竹,是有做會計之人告密呀!案件正是涉做假的商業文件,幾罪拼發。。。著草明顯是稅局不肯接受單罰款和解。。。你仲大言不慚激嬲稅局,如此斷後路,它日在中國有乜三長兩短被威脅,嘿,好自為之。。。

刪除公民身份都可以夾硬要人留㗎?仲要係美國咁講自由國家!任何國家嘅美國領事館係「US soil」,你被美國通輯,你踏入「美國領土」,點解唔可以拘捕你?點將佢運回美國先係大問題,中國唔肯嘅話,就係外交風波(因為一踏出美國領事館就係中國領土)。
脫離美藉係為未來設想,未離美藉前所有逃稅你都要承擔責任,即使你今日脫離美藉,IRC 877/877A 都仲可以敲你一筆,不過佢有張良計,一個好嘅稅務律師會有。。。嘿嘿
